About Todd J. McNamara
Expertise in Employment Law
With over 44 years of employment law experience and having litigated on both sides of the equation, I feel I have a unique perspective when it comes to evaluating or deciding employment law disputes. Undefeated on the defense side in Federal court, and with numerous multi-million recoveries on the employee side, I bring a wealth of knowledge and practical experience to the table. I am always thoroughly prepared and conversant with the facts and law of the case at hand, and tireless in my efforts to resolve claims in mediation, never hesitating to stay late to get the job done or persistently following up if the matter is not resolved immediately. With a success resolution rate of over 90%, I bring energy, compassion, and a sense of humor, when necessary, to what can be a very emotional and draining experience. Having developed a track record of success in litigating class and collective actions and having served as a Special Master in a class case, I am often asked to serve as a mediator in such claims and have successfully resolved more than a dozen in the past two years, ranging from high six figures to mid-and high seven figures.
Arbitration Experience
As a private practioner, I have successfully arbitrated dozens of employment and labor related matters. Additionally, as a result of my stint as General Counsel of United Food and Commercial Workers, Local 7, I actively arbitrated dozens of labor related issues and frequently appeared before the NLRB in a variety of contested matters. I bring my wealth of knowledge and experience in labor law matters to the arbitration arena. I have served on the American Arbitration Association panel of Employment Law Arbitrators for more than 15 years as well as their Commercial Law panel. Matters arbitrated either partially or to conclusion have included race and sex discrimination claims, breaches of covenants not to compete and trade secret violations, including highly complex multi-day arbitrations.
